Miers falls short of expectations

President Bush's Supreme Court nominee, Harriet Miers, is several votes short of confirmation this week. A Democrat on the Senate committee said there are too many questions about her qualifications. Only one or two senators said they would support her if it came to a vote today.

Miers has never been a judge but was nominated to replace Justice Sandra Day O'Connor, who is retiring. Some conservatives are troubled by her nomination and say it was risky because she has never given a judicial ruling on issues such as abortion and gay rights.

Democrats, on the other hand, are worried whether or not current White House counsel could rule independently once Miers was on the bench, given her close ties to Bush. Sen. Kay Bailey Hutchison, R-Texas, discarded suggestions that the White House was going to withdraw Miers' nomination.

"We have no idea what this woman's record is about," said Howard Dean, head of the Democratic National Committee. "She's obviously an accomplished attorney. The question is what does she believe? We have no idea," Dean told ABC's "This Week."

Student dies after homecoming tragedy

A student athlete died at the University of Minnesota-Morris campus after the school's homecoming football game on Saturday.

Richard Thomas Rose, junior, a member of the men's basketball team, was well liked by everyone, according to Sam Schuman, chancellor at Minnesota-Morris.

The 20-year-old student was killed when fans rushed the field and pulled down the goal post after winning the homecoming game. No one else was hurt and school officials say it was not immediately clear how Rose died.

Schuman said, "I think the presumption is that [his] death was caused by a blow from the goal post," The Kansas City Star reported.

Rose was one of about 1,700 students on the University of Minnesota-Morris campus, located about 135 miles northwest of Minneapolis.
